European Union policy
regarding Deforestation-Free for 8 commodities including rubber, coffee and cocoa as well as several
derivative products.
1) Deforestration-free means that a commodity or product that
relevant, produced not on deforested land/or harvested (specifically for timber)
without causing deforestation, after 31 December 2020 (cut of date).
2) Legality is defined as compliance with “legislation” in force in the country where
commodity is produced, in terms of: a) land use rights, b) environmental protection, c) party rights
third (human rights of indigenous peoples, etc.), and d) applicable trade & custom regulations.
3) This regulatory proposal has been approved in principle in the December 6 trilogue mechanism
2022 and in text on December 21, 2022. It is informed that in January 2023 or
February 2023 will see the establishment of this proposal as an EU regulation.
4) After regulation entry to force, operators and traders are given 18 months for implementation
new rules. MSMEs in the EU are given a little more time to adapt.
5) Operators and/or traders are required to carry out due diligence, which includes information
regarding the geolocation coordinates (geolocalisation coordinates) of all plots of land in
where the commodity was produced, along with the date/time range of production.
6) It was informed that this EU regulation is more targeting CPO commodity. Against questions
GAPKINDO regarding EU public opinion on natural rubber, the Ambassador provided information
that natural rubber is not much discussed. European society is very put
concern if what is carried out is the issue of the fate of small farmers (smallholders) who will
directly affected by this policy.

7) Dialogue will continue through diplomatic efforts related to these three commodities (rubber,
coffee and cocoa) so that they are classified as low risk commodities, so the obligation to

provide recommendations for commodities that are managed dominantly by smallholders at least
extended 3-5 years for preparation.
8) In closing remarks the Ambassador gave an opportunity to the association if
then there are things that need to be conveyed related to this policy. Questions, clarifications
or whatever can also be conveyed through the Directorate General of Agro Industry.
